Chi-ho Kwan is a Partner of Eric Chow & Co. in Association with Commerce and Finance Law Offices.

Chi-ho’s practice focuses on international arbitration and complex litigation in Greater China region and Asia. He has represented companies, equity funds and high net-worth individuals in high stake shareholder and contractual disputes particularly in international arbitrations administered under the rules of the Hong Kong International Arbitration Centre (HKIAC), the Singapore International Arbitration Centre (SIAC), the International Court of Arbitration (ICC), and the United Nations Commission on International Trade Law (UNCITRAL).  He also regularly represents multinational and local corporations, as well as professional indemnities and financial institutions in regulatory investigations and disciplinary inquiries, and has hands-on experience liaising with regulators including the Hong Kong Securities and Future Commission (SFC) and the Hong Kong Competition Commission (HKCC)

Chi-ho is a Solicitor Advocate of the Hong Kong Courts, with full rights of audience in the Hong Kong Courts in respect of civil matters.  He is also a Fellow of the Chartered Institute of Arbitrators (FCIArb) and is listed as an arbitrator with various arbitral institutions, including the Hong Kong International Arbitration Centre (HKIAC), Asia International Arbitration Centre (AIAC) and Korean Commercial Arbitration Board (KCAB).

Prior to joining Eric Chow & Co. in Association with Commerce & Law Offices, Chi-ho worked at Akin Gump Strauss Hauer and Feld, Latham and Watkins LLP and another "Red Circle" law firm.

Chi-ho was named by Legal 500 Asia Pacific as a ‘Key Lawyer’ for his work in International Arbitration in 2023.

Work Experience Includes Representation of:

International Arbitration

  • a Singaporean company in an HKIAC arbitration commenced against it by a company incorporated in Mainland China specializing in the furniture business concerning jurisdiction of the tribunal.
  • a Cayman software company in an HKIAC arbitration commenced by it against another Cayman company concerning a claim in excess of USD 4 million. The dispute arose out of a share transfer agreement governed by Cayman law.
  • two affiliates of a listed conglomerate in Malaysia and a British company specializing in the automotive industry in two HKIAC arbitrations against a PRC company concerning a claim in excess of USD 130 million. The disputes arose from various joint venture agreements to set up car production facilities in China.
  • a Chinese online gaming company in an ICC arbitration concerning an on-line gaming IP licensing dispute. The dispute sum was in excess of RMB 100 million.
  • a Chinese company in an arbitration concerning a dispute with a Japanese conglomerate arising from an OEM Agreement under the UNCITRAL rules.
  • a Thailand based company in a HKIAC arbitration against a global hotel group concerning a dispute arising from a Myanmar law governed Management Agreement.

Civil and Commercial Proceedings

  • the Hong Kong-based affiliates of one of the leading real estate developers in Mainland China in an action before the Hong Kong High Court against the minority shareholder and an individual to nullify certain filings made by them with the Hong Kong Companies Registry.
  • a syndicate of leading financial institutions concerning enforcement actions in Hong Kong, Cayman and BVI in relation to a facility agreement entered with a China-based coffee chain. The amount in dispute is in excess of USD500 million.
  • the main respondent in the first ever enforcement proceedings before the Hong Kong Competition Tribunal concerning alleged bid-rigging.
